The following terms and conditions govern your use of the information, materials, and documents made available to you at this website (the "Materials") and any purchases or orders ("Transactions") you make on this or any affiliated websites. Use of the Materials by you or the completion of any Transaction signify your agreement to all terms, conditions, and notices contained or referenced herein (the "Terms of Use"). If you do not agree to these Terms of Use please do not complete any Transactions or use this website or the Materials. We reserve the right, at our sole discretion, to update or revise these Terms of Use. Please check the Terms of Use periodically for changes. Your continued use of this website following the posting of any changes to the Terms of Use constitutes acceptance of those changes.

Reservation of Rights

The Park N Party^® name and logo, and all related product and service names, design marks and slogans are the trademarks or registered trademarks of Park N Party, LLC, a Michigan Corporation. All other product and service marks contained herein are the trademarks of their respective owners. You may not use any Park N Party^® or third party trademarks or logos without the prior written consent of Park N Party^® or the applicable trademark owner.

The service provided by Park N Party^® is limited to: providing our Customers with information concerning the expected availability of parking spaces, tailgate spots, and other products, services and amenities for specific events. The decision to utilize Park N Party^® services is solely your own and you are responsible for your decisions and assume all related risks. The allocation of parking spaces and tailgate spots within a Lot is solely in the control of the Lot Owner. A Lot Owner may or may not, at its sole discretion, attend or otherwise secure a lot or facility. Park N Party^® is not responsible for any consequences arising from the lack of suitable parking, nor do we make any specific representations about the safety, security, cleanliness, or viability of any particular lot, parking space, tailgate spot, product, service or amenity made available by a Lot Owner, its assignees, or representatives.

Resale of Reservations, Products, or Services Prohibited

In its sole discretion, Park N Party^® reserves the right to cancel or refuse any Transactions it may deem to be fraudulent, improperly paid for, in violation of its policies, terms and conditions or general business practices.

You shall not resell a Park N Party reservation(s), product(s), or service(s) to any third-party.  You shall not post a Park N Party reservation(s), product(s) or service(s) for resale on any third-party marketplace (e.g., StubHub or Craig's List).  You have no right to transfer a Park N Party reservation(s), product(s) or service(s) to any third-party without the expressed written permission of an Officer of Park N Party, LLC.  If, in its sole determination, Park N Party concludes that you have violated its prohibition against the resale of Park N Party reservations, products, or services, you agree that Park N Party may charge your credit card or debit card in the amount of Five-hundred Dollars ($500.00) or the difference between the Total Cost of the item(s) you purchased from Park N Party and the amount for which you resold it (them), whichever is greater ("Damages").  If Park N Party is unable to charge Damages to your credit card or debit card, Park N Party may pursue, at your sole expense, other methods of payment including, but not limited to, the courts and/or collections agencies.  Additionally, you agree to waive all rights to dispute a charge(s) for Damages with any credit card or debit card processor or in any court or arbitration/mediation forum. 

All Transactions shall be governed by and construed in accordance with the laws of the State of Michigan and shall in all respects be interpreted, enforced, and governed under the internal and domestic laws of such state, without giving effect to the principles of conflicts of laws of such state. Any claims or legal actions by one Party against the other arising out of a Transaction between the Parties or use of Materials shall be governed by the laws of the State of Michigan, and all actions and proceedings shall have their venue in Washtenaw County, Michigan, or the closest venue to the principle offices of Park N Party, LLC.

In the event you attempt to "back charge" a credit card transaction processed by our system on your behalf and the credit card processor dismisses your claim, you agree to be responsible for all costs and charges incurred by Park N Party in its defense of your back charge claim including, but not limited to, fees charged to us by a credit card processor, legal costs we incur in our defense of such claim, actual attorney fees, and other related charges. Such costs and charges to you shall not be less than One-hundred Dollars ($100.00) per item presented by you for "back charge" against us.

In all cases, your reservation or purchase of a parking spot, tailgate space, products, services, or amenities from Lot Owner (the “Reservation”) will be governed solely by the terms and conditions offered by the Lot Owner as may or may not be posted at their location, facility, or otherwise provided to you by them.

You agree to indemnify Park N Party^® against any costs, fees, or damages related to your use of the Lot or attendance at any event and to abide by our Terms of Use and all other policies.

Park N Party^® does not:

• Provide parking spots or services, tailgate spaces or services, operate a parking or tailgate lot or otherwise accept custody of motor vehicles or other property in any form. Such services are provided by others and they are in no way our agents or acting in our behalf;
• Accept any responsibility whatsoever regarding the safety or health of persons or property in the Lot selected by Customers;
• Warrant that the Internet, our website or any email from us is free of 'viruses' or other potentially harmful effects;
• Endorse the use of cell-phones or other communications devices while driving;
• Guarantee the availability of a specific parking space, tailgate spot, products, services, or amenities at the Lot you selected;
• Assume any responsibility whatsoever for the consequences of not being able to: park, tailgate, use or utilize any products, services, or amenities; to attend an event; or for any delays/postponements/cancellations as a result of weather, traffic, accidents, construction, health issues, pandemics, government orders/edicts, acts of God, or other obstructions or delays while going to, attending, or leaving an event.
• Guarantee holders of any form of Season Pass will not receive a refund or credit from Park N Party in the event a Lot Owner is unable to provide any services or products included as part of the Season Pass.  In such case, refund or credit decisions are in the sole discretion of the Lot Owner.    

Personal & Non-commercial Use

The Park N Party^® website and its associated appendages and Materials are intended for personal, non-commercial use. You may not use robots or other automated means to access this Site, unless specifically permitted by Park N Party^® . You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this Site. You agree to promptly update your Customer Profile information (if applicable) in order to keep it current, complete, and accurate.

Please be aware that even if you do not give us your real name, your Web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.

Permission is granted to electronically copy and print in hard-copy portions of this Site for the sole purpose of using this Site as a shopping resource. Any other use of Materials or Content on this Site, including reproduction for a purpose other than that noted above without Park N Party^® 's prior written consent is prohibited.

Privacy Policy

You confirm that you have read and accept our Privacy Policy, the terms of which are incorporated herein, and agree that the terms of this policy are reasonable and satisfactory to you. You consent to the use of your personal information by Park N Party, LLC and/or its third-party providers and distributors in accordance with the terms of and for the purposes set forth in the Privacy Policy. Park N Party, LLC makes no representation or warranty with regard to the sufficiency of the security measures used for data handling and storage. Park N Party, LLC will not be responsible for any actual or consequential damages that result from a lapse in compliance with the Privacy Policy because of a security breach or technical malfunction.

User Comments, Feedback and Other Submissions

All comments, feedback, suggestions and ideas disclosed, submitted or offered to Park N Party^® or any other user of this Site (collectively, "Comments"), shall be and remain the exclusive property of Park N Party, LLC and may be used by Park N Party^® in any medium and for any purpose worldwide without obtaining your specific consent. Comments may be used by Park N Party^® in any medium whatsoever, including, but not limited to, radio, television or print advertisements. Your first name, first initial of your last name, and town and state may be used with any Comments you submit. Park N Party^® is under no obligation to maintain your Comments (and the use of your first name and first initial of your last name with any comments) in confidence, to pay to you any compensation for any Comments submitted, or to respond to any of your Comments. You agree you will be solely responsible for the content of any Comments you make.
